The court of La Plata has rejected the request for work release presented by Felicitas Alvite, known in the media as "La Toretto", who is accused of culpable homicide with eventual intent for the death of motorcyclist Walter Armand (37), which occurred in April 2024 during an illegal street race.
The young woman had requested authorization to work as a nanny, arguing the need to reintegrate into the workforce while serving house arrest in a residence in City Bell, according to the Argentine News Agency from judicial sources.
The request was filed with the Oral Criminal Court No. 2 of La Plata through her defense lawyer, Flavio Gliemmo, who maintained that there was a concrete offer to care for an 18-month-old child.
However, in an update learned this Friday, December 19, Judge Claudio Bernard resolved to reject the application, considering that the conditions were not met to flexify the detention regime.
In his ruling, the magistrate stated that the job offer had not been properly verified and that there is no control mechanism, such as electronic monitoring, that would allow for supervision of compliance with the measure.
"The combination of an unverified job offer and the absence of a control mechanism (...) lead us to maintain that the request would only undermine the mitigation of preventive detention under house arrest," Bernard expressed in the ruling.
Alvite remains pending her oral trial for the fact that ended Armand's life after a fatal collision that occurred in the context of an illegal race.
For the accusation against her, she could face a sentence of up to 25 years in prison.
In the same judicial process, Valentina Velázquez, Alvite's friend, will also be tried. She is accused of her participation in the fatal race under the figure of "speed test". Both young women have been disqualified from driving.
The judicial decision once again puts the focus on the seriousness of the case and the limits of mitigations for preventive detention for those accused of traffic offenses with a fatal outcome, while awaiting the date for the oral trial.
